How to File an Accommodation Letter / Discrimination Complaint Associated with RF Radiation from Smart Meters

People with disabilities and medical conditions may feel they are being discriminated against – involuntarily exposed to RF radiation from smart meters on their property or neighboring properties that may cause harm, risk, exacerbate an existing condition, or are being charged fees to opt-out of smart meters for medical reasons (illegal surcharge). Accommodations may be requested of the PUC or utility for qualifying disabilities or medical conditions. A discrimination complaint may be filed if accommodations aren’t met.

Each state and local gov’t, including a municipal utility (run by local gov’t) is required to follow the Americans with Disabilities Act under Title II . Privately-owned utilities may be covered under Title III (see below). The ADA (more at is enforced by the US Dept of Justice (US DOJ). Privately-owned utilities that accepted federal funding for smart meter and smart grid projects also must follow certain additional federal discrimination laws, such as Section 504 of the Rehabilitation Act of 1973 (as amended), as it applies to equal access to program benefits and services (equal access to essential utilities such as electricity and gas or water)**, with enforcement by the US Dept of Energy.

People with qualifying disabilities**** under the ADA*** may wish to file a complaint against the state Public Utility Commission and the utility company involved, if they feel their rights have been violated through denial of accommodations for their disability or medical condition.

The complaint(s) would be filed with the US Dept of Justice (US DOJ) and/or the US Dept of Energy for Section 504 complaints (see below). Please note that there may be a time limit from the date the discrimination occurred (may be 180 days or less). It is recommended, if possible, to have legal assistance from an attorney or advocate skilled in disability rights to assist you in this process. Do an online search on “disability rights attorneys” to locate nonprofits with free disability rights clinics or attorneys who specialize in this area. The following is not intended to substitute for legal advice and our disclaimer applies to the use of this information.

First step:
1. Request the accommodations first, as they may be approved by the PUC or utility, in which case you will not need to file a DOJ complaint. Click HERE to see a sample accommodations request letter.

2. Write the state PUC and utility to request the accommodations.

3. You may refer to your disability or medical condition in general or choose to describe your disability or medical condition briefly, and how RF radiation impacts it.

4. It is helpful to confer with a supportive healthcare provider who will write a letter also making the request.

5. Request, specifically, the accommodations you wish to be provided with. These may be determined with your healthcare provider.
(for example: smart meters removed from your property and/or neighboring properties that impact your disability through exposure to RF radiation, analog (purely electromechanical) meters to replace them, no opt-out fees)

6. If you are denied, then you may file a complaint to the US DOJ (or US DOE, see below). You may also file a complaint if you have proof of a discriminatory policy of the state public utilities commission (ie. forcing smart meters and RF radiation on you and on everyone without regard for disability, or charging a surcharge or fee to avoid the radiation for medical reasons).
People with medical conditions under 504 (same complaint form for US DOJ), may first file an accommodations request to the state public utilities commission or utility as above based on a medical condition, rather than disability, or for both disability and medical condition(s) if applicable.

Second Step:

1. If your accommodations request was not granted, you may wish to file a discrimination complaint with the Department of Justice against the PUC and/or utility (whoever denied your accommodation request).

Note: To file a discrimination complaint against the utility also, you will need to find out if your utility is municipal or privately-owned. A municipal utility is run by local government. A privately-owned utility is owned by private interests, and is usually a corporation.

A Letter To Your Medical Professional About Wireless Smart Meters


Many people have medical devices, and/or implants that can be affected by RF radiation. In addition, many people are suggering from symptoms resulting from exposure to EMFs. Here is a letter that you can send to your doctor, courtesy of Una St. Clair of the Citizens for Safe Technology Society.

Dear Medical Professional:

Your patient has asked us for support in providing you with information regarding the possible health risks from non-thermal microwave radiofrequency electromagnetic radiation, recently reclassified by the WHO/IARC as a Class 2B, possible human carcinogen.

This WHO risk category also includes lead, DDT, chloroform, and HIV, and is relevant to all wireless devices emitting radiofrequency electromagnetic fields, including cordless phones, cell phones, IPads, Wi-Fi routers, wireless games, baby monitors, and smart meters.

A growing number of people (see item E (3)) are reporting sensitivities to pulsed wireless microwave radiofrequency emissions, and the most common symptoms reported are:

- Dizziness and vertigo
- Heart palpitations and arrhythmia
- Insomnia
- Extreme fatigue & exhaustion

Your patient is especially concerned that a wireless Smart Meter is being forced upon them without their consent, constituting uncontrolled and involuntary exposure within their home. These wireless meters send information in millisecond bursts of high intensity to reach collector units placed on power poles. Their home may also be designated a Smart Meter data collection point without their knowledge or consent.

Given that wireless information transmissions occur in milliseconds and there are 60,000 milliseconds in one minute, this would account for regular and continuous microwave “spikes” 24 hours per day when wireless functions are fully active. In addition to the information signals, the meters have a number of other wireless capabilities producing microwave radiofrequency emissions on an ongoing basis.

Mr. President,

Not only must deployment of these technologies be stayed immediately but opt out fees for smart meters must also be stayed and
switching back to electromechanical [analog] meters at no cost must be permitted. Smart meters are destroying lives now like no
other RF microwave device. There is no 10-30 year latency period as there is between moderate cell phone use and brain cancer. For
many people, the devastating results of meter exposure are immediate and acute. The cause and effect are clear although we have not
yet identified the mechanism or mechanisms [as we still have not with cancer].

There is at least a major segment of our population with knowledge of their acute electrical sensitivity [ES], sometimes referred to
as electrical hypersensitivity [EHS] or by other similar names. Estimates range from 3-10% which in actual numbers is huge. There
are probably another 20% exhibiting some of the various symptoms associated with electrical sensitivity who are not aware of the
cause. Some experts extrapolate based on known past incident trends that by 2017, 50% of the population will suffer from some degree
of electrical sensitivity.

By themselves and if manifested occasionally, common ES symptoms like ringing in the ears, headaches, fatigue, loss of cognitive
ability, insomnia, cardiac arrhythmia and nosebleeds may be minor problems but when these become chronic and acute as is generally
the case when sensitive populations are exposed for example to smart meters, the effects are debilitating and life destroying.

Because sensitivity can be acquired by exposure, we are all truly susceptible. Those with responses at present appear to be our
“canaries” and the problem is getting worse daily with the increased proliferation of what is now being termed electrosmog. Many of
us knowledgeable on this and other environmental and medical matters consider low level, presumably non-thermal, RF exposure to be
at least one of the greatest uncontrolled and toxic biological experiments of our time.

Recent survey data from the Maine Coalition to Stop Smart Meters show definitively there is something unique about smart meters that
triggers new sensitivities in individuals [including those who had no knowledge a meter had been installed and knew nothing of the
issue] and worsens symptoms in those with existing symptoms. Survey results can be read on the Coalition web site as part of a
recent expert filing in the ongoing Maine PUC investigation into the safety of smart meters.

Smart meter exposure in particular seems an unprecedented national health emergency deserving immediate attention. Meters are
mandatory as opposed to the optional use of a cellphone although we are all starting to become victims of “second hand RF” from
other users and that is also involuntary. While some states offer opt out programs and the ability to retain the tried and true
analog meter, this is a false choice since with one exception [VT for now], additional coercive fees are required. Ratepayers faced
with the “choice” of having to pay to avoid harm or threat of harm rightly call this extortion, a federal crime prohibited by the
Hobbs Act.

Contributions to both political parties by utilities and telcom industries are probably unmatched. So too the suppression of
evidence by these industries over the years, of data showing harmful biological effects from low level radiofrequency microwave

Cell and cordless phones linked to cancer

Lennart Hardell, MD at Orebro University, Sweden says, “There is a consistent pattern of increased risk for glioma (a malignant brain tumor) and acoustic neuroma with use of mobile and cordless phones.” He further states:

“Epidemiological evidence shows that radiofrequency should be classified as a human carcinogen. The existing FCC/IEE and ICNIRP public safety limits and reference levels are not adequate to protect public health.”

A dozen new studies link cell phone radiation to sperm damage. Even a cell phone in the pocket or on a belt may harm sperm DNA, result in misshapen sperm, and impair fertility in men. Laptop computers with wireless internet connections can damage DNA in sperm.

Based on strong evidence for vulnerable biology in autism, EMF/RFR can plausibly increase autism risk and symptoms. ” While we aggressively investigate the links between autism disorders and wireless technologies, we should minimize wireless and EMF exposures for people with autism disorders, children of all ages, people planning a baby, and during pregnancy,” says Martha Herbert, MD, PhD.

Wireless devices such as phones and laptops used by pregnant women may alter brain development of the fetus. This has been linked in both animal and human studies to hyperactivity, learning and behavior problems.

There is more evidence than we need

“The last five years worth of new scientific studies tell us the situation is much worse than in 2007 and yet people around the world have so much more daily exposure than even five years ago. Exposures are linked to a variety of adverse health outcomes that may have significant public health consequences.” (Editor’s notes)

“There is now much more evidence of risks to health affecting billions of people world-wide. The status quo is not acceptable in light of the evidence for harm.” David O. Carpenter, MD, co-editor Bioinitiative 2012 Report.

This study covers EMF from powerlines, electrical wiring, appliances and hand-held devices; and from wireless technologies (cell and cordless phones, cell towers, ‘smart meters’, WI-FI, wireless laptops, wireless routers, baby monitors, and other electronic devices). Health topics include damage to DNA and genes, effects on memory, learning, behavior, attention, sleep disruption, cancer and neurological diseases like Alzheimer’s disease. New safety standards are urgently needed for protection against EMF and wireless exposures that now appear everywhere in daily life.

And on smart meters:

An urgent example for the need to address the lack of adequate public protection from inadequate safety standards for pulsed RFR exposures is the rapid, global rollout of wireless utility meters (‘smart’ meters for electricity, gas and water meters). Current safety standard calculations that rely on time-averaging of RFR almost entirely dilute out the power density of RFR levels that are delivered in millisecond bursts, but occur at intervals of every second, or multiple times per second when in use within a wireless mesh network. Said differently, the RFR power density levels are usually legal. While there have been no long term studies of adverse effects of smart meters on human health (primarily because they are so new), there are increasing reports from electrosensitive individuals of harm. Added together, these RFR pulses that now appear to be a highly bioactive agent but are essentially erased or made energetically invisible by time-averaging the pulses as current FCC safety rules mandate.

The wireless meters transmit RF signals like a mini-cell tower antennas in the cell phone radiation frequencies. Currently, they are being deployed in the US and are on the drawing boards around the world including many European countries. The ‘smart meter’ infrastructure represents the largest single commercial saturation of living space with pulsed RFR yet rolled out by industry. This program places a wireless device (like a mini-mobile phone base station) on the wall, replacing the electromechanical (spinning dial) meter. They will be installed on every home and classroom (every building with an electric meter). Utilities from California to Maine have installed tens of millions already, despite health concerns of experts who already are seeing thousands of health complaints. The wireless meters produce spikes of pulsed radiofrequency radiation on a continuous basis (24/7), and in typical operation, will saturate living space at levels that can be much higher than already reported to cause bioeffects and adverse health effects for some people. These meters, depending on where they are placed relative to occupied space in the home or classroom, can produce RFR exposure levels similar to that within the first 100 feet to 600 feet of a mobile phone base station (cell tower). In the not-so-distant future the plan is to have a wireless device implanted in every household appliance, which will communicate with the smart meter whenever electricity is being used. This will likely make the kitchen a major source of exposure to RFR.

The cumulative RFR burden within any community is largely unknown. Both involuntary sources (like cell towers, smart meters and second-hand radiation from the use of wireless devices by others) plus voluntary exposures from ones’ personal use of cell and cordless phones, wireless routers, electronic baby surveillance monitors, wireless security systems, wireless hearing aids, and wireless medical devices like implanted insulin pumps all add up. No one is tallying up the combined exposure levels. Billions of new RFR transmitters from a global smart meter rollout will significantly add to the existing RFR body-burden of pulsed RFR for millions of people. The health concerns are the same as with all other sources of EMF/RF. Cancer is the most serious adverse effect, but alteration of male reproduction and central nervous system effects may results from even lower levels of exposure. The work by Strogatz (2001, 2003) and Bezsaki (2006) on weak-field effects on non-linear biological oscillators (brain waves and synchronization of neural activities that regulate body processes) is directly relevant to an understanding of the profound biological disruptions and health symptoms that continued exposures of pulsed RFR may produce.

Lawmakers Weigh In on Smart Meter Consent Issue


Lawmakers may again weigh in on just how smart a meter can be before consent needed

PLYMOUTH — “I feel that for the first time in nine months leadership is paying attention,” Joan Wirth of Bristol said yesterday. She has been at the forefront of an effort to stop the New Hampshire Electric Cooperative (NHEC) from installing so-called “smart meters” to its 83,000 customers in 115 municipalities, including a small section of Laconia and and all or parts of eight towns in Belknap County.
Last month, the Grafton County Commission voted two-to-one — with Commissioners Omer Ahern and Ray Burton in favor and Commissioner Michael Cryans against — to advise the NHEC to abandon the mandatory installation of smart meters in favor of a consensual program. Soon afterwards Representative Paul Simard (R-Bristol) expressed concerns that smart meters compromised the privacy of individuals and families while risking the health and safety of customers and said that if necessary, he would introduce legislation requiring that they not be installed without the customer’s consent.

Since the NHEC began installing smart meters in June 2011 the project has been dogged by controversy, most of it originating from Hundred Acre Wood, the neighborhood in Bristol where Wirth makes her home. In February, Wirth and others asked the Grafton County Superior Court to halt further installations. When their petition was denied, she said that rather than pursue costly litigation she turned to the New Hampshire Public Utilities Commission (PUC) and the New Hampshire Attorney General. Last week the PUC denied Wirth’s request for a public hearing while the Attorney General has yet to take action.

Apart from the privacy, health and safety issues, Wirth and her supporters contend that a state statute enacted last year (RSA 374:62) requires the NHEC to obtain the expressed consent of customers before installing any type of smart meter. Although that was the original intent of the Senate Bill 266, it was amended to implicitly distinguish between two types of smart meter — the basic smart meter and “smart meter gateway devices.”

The statute prohibits utilities from installing “smart meter gateway devices” without the consent of property owners. The law defines a “smart meter gateway device” as “any electric utility meter . . . which serves as a communications gateway or portal to electrical appliances, electrical equipment, or electrical devices within the end-user’s residence or business, or which others communicates with, monitors, or controls such electrical appliances, electrical equipment, or electrical devices.”

The basic smart meter — sometimes called a “dumb” smart meter — like a conventional meter, records electric usage, but displays it in a digital format and transmits through a microwave and fiber optic network to the NHEC’s headquarters in Plymouth. Each meter transmits for about 1.5 seconds between seven and 10 times a day, eliminating the need for meter readers.

Wirth insists that despite the definition the statute applies to all smart meters, which she described as “surveillance devices” that emit dangerous levels of radiation and pose severe risks of fire.
Seth Wheeler, speaking on behalf of the NHEC, said that the statute does not apply to the basic smart meters the utility is installing.

The NHEC has installed some 78,000 basic smart meters and expects they will be provided to the remaining customers by the end of October.



Representative Calls for Oversight on Smart Meters


CONCORD – Rep. Paul Simard today raised concerns about “smart meters” being installed by the New Hampshire Electric Co-op (NHEC). Pennsylvania and Maryland are both investigating allegations that the electric meters have sparked house fires. Simard also cited concerns over the meters not being UL tested or certified.
At a Grafton County Commissioners’ meeting last month, both Commissioner Omer Ahern and Commissioner Raymond Burton voted to advise and suggest to the New Hampshire Electric Cooperative that they discontinue the program of mandatory installation of any “so called” smart meters and that if any Coop member wants to have them installed it would be by an “opt in” procedure.

“I’m very concerned that the co-op has chosen to continue installing smart meters in spite of privacy and health concerns and reports of the electric smart meters sparking fires. This year the legislature passed Senate Bill 266, which prohibits electric utilities from installing and maintaining smart meter gateway devices without the residential or business property owner’s consent. However, confusion in the legislation on what classifies a smart meter may make it necessary to file corrective legislation, which I plan to do if needed. I’ve attempted but not yet been able to get clarification from the attorney general’s office.”
